Confidentiality & Limits of Confidentiality of Mental Health, Alcohol & Drug Abuse Client Records

The confidentiality of mental health, alcohol abuse, drug abuse, and/or eating disorder Client records maintained by this program is protected by laws and regulations. The limits of confidentiality include that the program may not say to a person outside the program that a Client attends the program or disclose any information identifying a Client as an alcohol or drug abuser, UNLESS:
The Client consents in writing
The disclosure is allowed by a court order; or
The disclosure is made to medical personnel or to a qualified person for research; or
The disclosure is made to protect by any threats to self or others (Duty to Warn)
The disclosure allowed if a crime has been committed.
The disclosure is made for audit or program evaluation; or
The disclosure is made of suspected child or elderly abuse or neglect from being
reported under State law to appropriate State of local authorities.
The disclosure is made if any information about a crime committed by a Client
either at the program or against any person who works for the program or about any threat to commit such a crime.
